Created in 1994, CAMVAP is the largest consumer product arbitration plan in Canada. Its mandate is to help consumers resolve disputes with vehicle manufacturers or distributors. CAMVAP is available to owners and lessees of both new and used vehicles.
CAMVAP is a program designed to help you resolve disputes with an automotive manufacturer on two main issues:
- the quality of your vehicle
- how the manufacturer interprets or implements its New Vehicle Warranty
The cost of CAMVAP is covered by vehicle manufacturers.
What is arbitration?
When you agree to CAMVAP arbitration, this means that both you and the vehicle manufacturer will accept the decision of an impartial person. This arbitrator will schedule a hearing to listen to both sides of the case, weigh the evidence, and make a decision. That decision is final and binding on both you and the manufacturer.
CAMVAP arbitration can award:
- repairs to your vehicle
- buyback of your vehicle
- reimbursement for repairs already made
- limited out-of-pocket expenses to a maximum of $500
- no liability on behalf of the manufacturer
An alternative to court.
You have a choice on how to settle your dispute: court or CAMVAP. Choose wisely, and be aware that when you use one, you will no longer be eligible to use the other. Weigh the pros and cons of each carefully, and compare your alternatives closely. The range of awards through CAMVAP may be more ' or less ' than those of the court.
An eligibility 'check list'
- Is your dispute with the manufacturer about an alleged manufacturing defect or implementation of the new vehicle warranty?
- Are you a resident of Canada in a province or territory other than Quebec?
- Was your vehicle originally purchased from a manufacturer's authorized dealer in Canada?
- Is the vehicle used primarily for personal or family use?
- Is the vehicle from the current or previous four model years?
- Have you followed the manufacturer's dispute resolution process?
- Have you given the dealer and the manufacturer a reasonable number of opportunities to resolve the alleged problems?
If you have answered YES to all of these questions, you might be eligible for CAMVAP.
